For most of us who were old enough to vote in the 1980s, we remember buying the same songs by the same artists, time and time again. We bought the album in our teens, and maybe the eight-track tape when we had our first car. When we got a little older, we bought the same album again in cassette form, and when the 90s rolled around, we bought it one more time on CD. Every time we bought that “album”, a lot of money changed hands.

The artist got a few pennies, the composer got a few, maybe the musicians got some, the publishing house got some, and the record company who produced and distributed the actual piece of media got paid, too. When the same album came out, yet again, in an MP3 format, everyone was paid again.

There is a type of music that can be downloaded without paying anyone a cent – MP3 public domain music. This type of music is available to everyone to use for whatever reason they want. MP3 public domain music is not pirated or stolen music. It is music that has been transferred to the public domain either because its license has expired or because its origins are unknown. Older compositions by classical artists are generally considered public domain. Nursery rhymes, national anthems, and many songs from early in the 20th century are considered public domain. Anyone who has ever created a blog or put together a posterboard presentation for school knows that not all art is yours for the taking. Generally speaking, company logos cannot be used without the permission of the company. There are typefaces that are so recognizably linked to a company that they cannot be used (Coke, Disney, Hershey’s, Budweiser). There are also pieces of art – specifically art produced in the 20th century and later – that is linked to a living, breathing artist who has the legal right to a royalty for every time his or her work is displayed or reproduced.

An alternative to this type of art which is called royalty art, is something called public domain art. Public domain art is any artistic piece that can be used freely by any member of the public. Public domain art becomes public domain for several reasons. In some cases, a drawing, sculpture, or painting cannot be linked to a particular artist. Any depiction of “King Tut”, for instance is royalty-free because no one knows exactly who crafted the King Tut statue. This is public domain art.

Some art is not so easy to identify as public domain. For instance, small graphics used to brighten up websites may be used by many people, but that does not mean they are public domain. Can a Public Domain List Help You Create a Profit?

Everyone knows someone who has an iPod that is full of songs that they never bought – they downloaded them for free from the internet. Everyone has also visited a website that is littered with photos of celebrities or extravagant graphics.

The only reliable way to make sure you are using PD work is to access a verifiable list. Such a list should show an accurate listing of places to find PD pieces that are free for you to use. Not only can you use pieces from a public domain list for your own enjoyment, but you can also use them for profit.

Where Can I Find a Public Domain List?

If you have been using the internet for awhile, you are well aware that there are some fast and loose rules regarding the rights of authors, musicians, and artists. It seems that people share music and movies, software and audio books as if they were all free. Doing so is, of course, completely illegal.

If you a student or work in a position where you commonly have to produce presentations, you know how hard it can be to find music to play in the background.
