Sometimes it is a well-known song that you can’t put your finger on. Maybe it is something traditional or classical, or just a very old tune that even your grandmother would know. The term “public domain” is used to refer to music (and other art forms) that can be used freely by anyone for any purpose. When you use a song that belongs to someone else, you have to pay them.

One of the nice things about public domain work is that once you download it and alter it in any way, it is yours. By altering the music or book, you have created a new piece of art which can require others to pay you royalties. In this way, if you download public domain music, you can use other’s original work (and a little of your own) to create a product that you can sell for profit.

Can a Public Domain List Help You Create a Profit?

Everyone knows someone who has an iPod that is full of songs that they never bought – they downloaded them for free from the internet. Everyone has also visited a website that is littered with photos of celebrities or extravagant graphics.

The songs on that iPod, and the photos and graphics in most cases are pirated. And, as such, they are illegal. Some people may argue that the internet is one big “free for all”, but in order for artists to continue producing the work we all love, they must be paid for it. Now, following this definition, media is work that has an expired license (for example, it was created more than 50 or 100 years ago), it is a traditional song or piece of art, or it is a piece of music or art that was intentionally created to remain in the P.D.

The only reliable way to make sure you are using PD work is to access a verifiable list. Such a list should show an accurate listing of places to find PD pieces that are free for you to use. Not only can you use pieces from a public domain list for your own enjoyment, but you can also use them for profit.

Making sure you are using PD art or music and not work that belongs to others is vitally important in making sure your business is free from potential legal prosecution.

Where Can I Find a Public Domain List?

If you have been using the internet for awhile, you are well aware that there are some fast and loose rules regarding the rights of authors, musicians, and artists. It seems that people share music and movies, software and audio books as if they were all free. Doing so is, of course, completely illegal.

In general, there are two types of media available. The traditional media that we all know and love – songs by Nick Lowe, movies by Paul Rudd, or books by David Sedaris – are all owned by the person who wrote them. And because they are owned, they are owed money for every time their music is played, every time their movie is viewed, or every time their book is read. A lot of people completely ignore these laws and do so at their own peril.
